You need a SWMS when you're doing high-risk construction work. You'll also often be asked for one by a principal contractor or client before you can get on site, even when it isn't strictly required by law.
When is a SWMS legally required?
Under the model WHS Regulations, a SWMS must be prepared before high-risk construction work (HRCW) begins. There are 18 categories of HRCW. You need a SWMS if your work involves any of them, including:
- Work where there is a risk of a fall of more than 2 metres
- Work on or near powered mobile plant (excavators, skid steers, EWPs)
- Excavation to a depth of more than 1.5m, and trenches
- Demolition and structural alterations
- Work involving asbestos
- Work in or near traffic corridors or a road
- Work near energised electrical installations or services
- Work in confined spaces, near water, or over pressurised gas/chemical lines

Why do sites ask for a SWMS?
Even for work that isn't high-risk, most tier-1 builders, government clients and principal contractors require a SWMS as part of pre-qualification or site access. In practice, having a solid SWMS ready is often what stands between you and starting the job.
Who is responsible for the SWMS?
The business (PCBU) carrying out the high-risk work must prepare the SWMS, developed with the workers doing the task. If you're a subcontractor, the principal contractor will usually want to review and accept your SWMS before you start, and monitor that the work is done in line with it.
Do SWMS requirements differ by state?
Most states and territories use the harmonised WHS laws, but Victoria runs its own OHS Act 2004 and Regulations (and refers to "high risk construction work" with its own requirements), regulated by WorkSafe Victoria rather than a "SafeWork" body. A generic "national" template can reference the wrong Act and regulator, which is why our documents are written per state.
